Testimony as informed communication of the witness in oral trials

Abstract

This article discusses results of research on witnesses testimony during oral trial under the new prosecution system in Chile and later interviews with the same witnesses alter their trial experience. The research describes these testimonies by means of an analysis of subjectivity in enunciation and of the interpretive repertories of those who acted as witnesses, as constructured vis a vis the pragmatic conditions of the utterance. The present contribution complements the traditional approach to testimony, which focuses on the psychological processes of recollection and memory distortion.
